Limitations of Use

By using this website or app, you warrant on behalf of yourself, your users, and other parties you represent that you will not:

Intellectual Property

The intellectual property in the materials contained in this website and app are owned by or licensed to Fitydoo and are protected by applicable copyright and trademark law. We grant our users permission to download one copy of the materials for personal, non-commercial transitory use.

Your health

Use of the Fitydoo services is at your own risk.

In any case a condition for the use of the Fitydoo services is that you must be in a good general state of health. If you have knowledge of any pre-existing medical conditions we advise you to seek medical advice from a doctor urgently before you start the Fitydoo services. This applies in particular if you have knowledge of one or more of the following medical complaints/conditions/procedures:

  1. cardiovascular disease,
  2. lung or respiratory disease (including asthma),
  3. spinal and/or joint problems,
  4. neuromuscular disease,
  5. surgical procedures,
  6. any other health issues

In addition our female users should note that pregnant women and breast-feeding mothers should not do the trainings offered by us.

Before using the Fitydoo services for the first time or while using Fitydoo, if you have any doubts about your health (e.g. because you are experiencing considerable pain, a general malaise, shortness of breath, nausea or dizziness) consult your doctor before starting or continuing with Fitydoo.

The services and information offered by Fitydoo do not constitute medical advice or a doctor's advice. Nor are they a substitute for a medical examination or treatment by a doctor.

Fitness advice is subject to constantly evolving knowledge in relation to health science and sports science. Although we base our training tips on current studies and knowledge, we do not guarantee that these reflect the most up to date research findings or knowledge.

Liability

Our app, website and the materials on our website and app are provided on an 'as is' basis. To the extent permitted by law, Fitydoo makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, or other violation of rights.

In no event shall Fitydoo or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use this website and app or the materials on this website and app, even if Fitydoo or an authorized representative has been notified, orally or in writing, of the possibility of such damage.

In the context of this agreement, “consequential loss” includes any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity, or otherwise.

Right to Terminate

We may suspend or terminate your right to use our website or app and terminate these Terms of Service immediately upon written notice to you for any breach of these Terms of Service.

Severance

Any term of these Terms of Service which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity of the remainder of these Terms of Service is not affected.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Poland. You irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
